PAS asks for audit of investments in Giurgiulesti Free International Port

The Party “Action and Solidarity” (PAS) signals deficiencies and illegalities in the process of signing and monitoring the implementation of the agreement of investment in the Giurgiulesti Free International Port. It requests the authorities to publish the accord and calls on the Audit Office to resume the audit mission, IPN reports.

In a press release, the PAS says there are two major problems related to the signing and monitoring of the implementation of the mentioned agreement – the way in which the transaction was legalized and how the parties fulfill the commitments provided in the accord.

According to the PAS, the investment agreement was classed as an international treaty. The Ministry of Justice didn’t have objections to this when the accord was approved, but later the Ministry of Foreign Affairs declared that this accord is not an international treaty because one of its parties is not an international law subject. None of the three companies that signed the investment agreement represented the Azeri Government. These were registered several days before the accord was signed. They were based in Moldova and didn’t have foreign capital.

Under the law on international treaties, the agreement should have been published in the Official Gazette, but this hadn’t been done.

As regards the fulfillment of the commitments, the party says the refinery wasn’t built within seven years of the signing, as it was stipulated in the accord. The Government and the investor accuse each other, the latter invoking the fact that the Government didn’t provide all the plots on which the refinery was to be built. According to the PAS, the Government promised to allocate land, but this promise was unrealizable.

“Even if the passenger port was to be constructed by SRL Azertrans in 2008, at the suggestion of Minister Igor Dodon, the Government decided that this facility would be built by the Ministry of Transport and Road Management through the Ungheni Fluvial Port. The state spent 100 million lei on this facility, but this money was to be provided by the investor. However, the concessions given to the investor weren’t reviewed,” said the PAS, noting that the concessions were substantial and the subject was to be examined by the Audit Office, but the audit mission was suspended by the previous composition of the Office.
