Presumption of legal character of property applies to everyone, CC

The property of a person is considered to be legal until it is proved that it was obtained illegally. This constitutional principle applies to all the persons, including public servants and other budget-funded persons, said the Constitutional Court, quoted by Info-Prim Neo. The Constitutional Court pronounced on the issue after Minister of Justice Oleg Efrim asked the institution to specify if the presumption of the legal character of the earned property, instituted by Article 46, paragraph (3) of the Constitution, equally protects the property of the civil servants and other persons paid by the state. The minister argued the given presumption is not an absolute right as the state, in the person of the prosecutor, is exempted from proving the illegal character of the earned incomes. The Court ruled that the minister’s request lacked constitutional foundation. The presumption of the legal character of the earned property is a norm that cannot be changed by interpretation. The Constitutional Court’s decision is final.
