The Superior Council of Magistracy (SCM) decided to remit the files of a number of judges to the College for the assessment of performance of judges and the College for the selection and career of judges for consideration, not yet in the case of Chisinau Appeals Court judge Vladislav Clima. The examination of the matter concerning his promotion to an administrative post or to a hierarchically superior court was postponed, IPN reports.

SCM acting president Dorel Musteață said there are a number of objections as to judge Clima. A judgment passed by Vladislav Clima, which was disseminated in the public sphere, shows that he ordered to collect US$700,000 from an offshore firm in favor of a Moldovan company. Earlier, the inspectors ascertained that the case was taken by the Anticorruption Prosecutor’s Office for examination. The institution was asked to say if a criminal case was started over this and if the case involves judge Clima.

Another case featuring the judge refers to a Chisinau Appeals Court judgment by which a firm was allotted 1.1 ha in a public park. This decision was quashed by the Supreme Court of Justice and the Judicial Inspectorate is to examine the judges’ actions in this case.

Minister of Justice Fadei Nagachevski said there are many quashed court decisions and such proceedings are instituted not in all the cases. When it is about the promotion of a judge, it is the duty of the assessment college to determine if there are elements that cast doubt on the integrity and professionalism of the judge or not.

The files of judges Dmitrii Fujenco, Viorica Severin, Aliona Miron, Roman Pascari, Ion Dadu, and Ludmila Iarmaliuc were sent to the two colleges.

In the same meeting, there was approved the Judicial Inspectorate’s activity plan for 2020. Under this, the organizational activity of five courts, namely how they registered and handed over cases, how they compiled decisions and their managerial efficiency, will be assessed.
