General Mayor Dorin Chirtoaca was heard Thursday by prosecutors as to the penal inquest related to the appointment of Health Direction chief Moldovanu, Info-Prim Neo reports. He was subpoenaed officially for the first time in this probe. The hearings in the prosecutor's office lasted an hour and a half. “I have explained repeatedly, as I told the municipal councilors, the powers given to me by the Law on local public administration and appointing the direction chief was done according to the law,” the mayor told journalists after hearings. He says the dossier “is done under instruction” and called it “a useful thing of the prosecutor's office and of the one having instructed it to do so.” “Again they made analogies with district councils and I told them clearly how the new Law on public administration separates the powers of the district council, of the municipal council, of the mayor, and expressly specifies that appointing directors is the mayor's competence. “On the eve of the (2007) elections interim mayor Veaceslav Iordan also appointed a number of direction heads, and his ordinances were not sued, as the directors go on working,” the mayor said. “This is not the first and the last file he is indicted in and this is the way how the current government works.” Dorin Chirtoaca's lawyer, Ion Casian, says the mayor is accused of power abuse, that he considers “groundless and abusive” and there are no legal grounds to start the penal inquest. He says he'll sue the ordinance on starting the inquest. Prosecutor Valeriu Bodeanu declined to comment anything. A guard told the media the prosecutor was busy in that moment, and suggested the reporters to return on other occasions. When asked by phone, Bodeanu has told Info-Prim Neo the mayor's statements about the “under-instruction” file are “aberrations.” “We do not make files under instruction, all are within the boundaries of law,” the prosecutor said. He declined to tell other people's name to be heard in the inquest. A similar file related to the appointment of Constructions Direction head Vasile Panfil will be re-judged. According to the mayor, “exactly the fact that that file was retunred to be re-judged confirms the prosecutor is far being right.”
