State officials who did not submit income statements face only disciplinary punishment

The lawmakers, members of the Government, judges, prosecutors and other state officials and public servants who did not present income statements for 2009 run the risk of being investigated by the Center for Combating Corruption and Economic Crime (CCCEC). However, the penalties that will be imposed will be disciplinary, not criminal as the legislation of Moldova is ambiguous, Minister of Justice Alexandru Tanase said on May 17, Info-Prim Neo reports. The income and property statements submitted by the public persons were examined by the competent commission. They were taken from the Ministry of Finance and stored at the CCCEC. The commission's secretary Veaceslav Boghirca said there were analyzed about 850 statements. It was established that income statements were not presented by the MPs Ludmila Belcencova, Valentin Cheptene, Mihai Carlig and Iurie Stoicov. At the same time, discrepancies between incomes and property were identified in the statements filed by the lawmakers Olga Miron, Ghenadie Morcov and Oleg Babenco. The MPs Oleg Serebrian, Mihai Godea, Oazu Nantoi, Igor Corman, Valentin Guznac, Valentina Stratan and the persons who entered the Parliament later to replace a number of legislators submitted the income statements with delay. Only the governor of the Autonomous Territorial Unit of Gagauzia Mihail Formuzal did not file the statement among the members of the Government. The commission established that some of the officials declared only the incomes for 2009, not yet the property owned. The list that will be submitted to the CCCEC includes mainly judges of central and local courts. “We need accurate legislation that will be predictable both for those who must declare their property and for the society,” said Minister Alexandru Tanase, who is a member of the commission. According to him, a government working group was set up to formulate proposals for modifying the legislation by this yearned. “A special body could be created to efficiently investigate every case apart. If the laws are not modified, all of them will be offenders who cannot be identified,” Tanase said. The state officials who filled out the income statements incorrectly or did not submit them face a disciplinary punishment that is not yet applicable to all the functionaries. The head of the CCCEC Viorel Chetraru said the punishment in such cases should be criminal, but the Moldovan legislation does not prescribe such penalties.
