Vaccine against promotion of personal interests by public servants
The Center for the Analysis and Prevention of Corruption (CAPC) welcomed the switchover to the private system for fulfilling court decisions at a news conference, Info-Prim Neo reports.
In an expert report, the Center says the non-fulfillment of the court decisions in Moldova makes the work of the courts of law useless.
The bill on the organization of the forced fulfillment of the court decisions envisions reforms that such countries as Lithuania, Romania, Latvia, Estonia and Bulgaria implemented after encountering the problems that Moldova is facing now.
The Center's director Galina Bostan said that after the bill is adopted, the work of the bailiffs will be monitored by the National Bailiffs Union instead of the Ministry of Justice. The Ministry will yet continue to issue licenses, suspend and stop the work of the bailiff, impose disciplinary punishments on the bailiffs.
In this connection, the Center recommends that the bailiffs who did such work before the reformation of the system should not take tests as they already showed that they have the necessary abilities and knowledge. Contacted by Info-Prim Neo, the spokeswomen for the Ministry of Justice Tatiana Pashkovski said that the test will be obligatory for all the persons who will want to act as bailiffs, with no exception. The move is aimed at removing the discredited persons and those who do not meet the professional and ethical standards.
In the same news conference, the Center for the Analysis and Prevention of Corruption presented the expert report on the bill regarding the Main Ethics Commission, its structure and work methods.
Cristina Cojocaru, one of the authors of the report, said the Center does not agree with the term for examining the income and property statements, which is too short.
“The authors of the bill repeat the mistake committed when formulating the documents concerning the work of the commissions that check the income and property statements,” Cojocaru said. “The Ethics Commission will have to examine 22,000 statements during only 15 days.”
The authors of the report said the Ethics Commission will probably start work on March 1, 2010. It will have five members that will be appointed for a four-year period and a budget of about 2 million lei.
The bill says that the income and property statements will be submitted by all the civil servants during the first days of the appointment. The data will be then confirmed or refuted by another statement.
The public servants will have to declare if they do some other paid jobs, if they are founders of shareholders of companies, if they have relations with international organizations and provide other information that could make the personal interests prevail over the public interests in certain situations.
