Constitutional Court passes judgment

The legislative body cannot institute another majority for electing the head of state by organic law when the Parliament is dissolved repeatedly following the non-election of the President. The Constitutional Court’s decision made public by chairman Dumitru Pulbere is definitive, Info-Prim Neo reports. “The Court ruled that the head of state in the first and second rounds of voting and in rerun elections is elected by the votes of at least 3/5 of the lawmakers, as stipulated in Article 78, paragraph 3 of the Constitution. The Court based its decision on the principle of preeminence of the Constitution. No organic law can intervene in the constitutional norms,” said Dumitru Pulbere. The Constitutional Court was asked to interpret Article 78 of the Constitution by a group of lawmakers of the ruling alliance. Thus, the head of state is elected by at least 61 votes in any situation.
