Constitutional Court says liquidation of economic courts is unconstitutional

The liquidation of the economic courts is unconstitutional, ruled the Constitutional Court after examining an application filed by Communist MPs, Info-Prim Neo reports. The authors of the challenge - Sergiu Sirbu, Artur Reshetnikov and Igor Vremea - said the activity of the specialized courts of law is regulated by the Constitution and an organic law cannot annul this provision. Sergiu Sirbu said the legislature has the right to set up courts, not yet to liquidate them. “The irremovability of the judge bans their transfer to other courts. But the new law allows this. Otherwise, the judges risk being dismissed. This shows lack of respect for the judges of the economic courts and military courts,” said Sirbu. The Government’s representative, Minister of Justice Oleg Efrim expressed his regret at the Court’s decision. He said that the amendments to the legislation were made within the process of modernizing the judicial system and the judges of the specialized courts were to be transferred to common law courts and they could resign and keep their titles and honors if they did not like the new place. “We speak about reforms and want results, but most of the initiatives aimed at changing something in the legal system are annulled by the Constitutional Court. Maybe we should think about making changes at the Court,” said Oleg Efrim. The challenge was examined without the president of the Constitutional Court Alexandru Tanase as the Communist lawmakers asked excluding him from the deliberations because he was one of the authors of the legal norm and could not be impartial. They also asked not allowing judge Victor Puscas to take part in the examination of the application because he pronounced on the subject in his thesis for a Doctor’s Degree. But this request was rejected. The law on the removal of the specialized courts from the judicial system was adopted on July 22, 2011. Under it, the powers and duties of the economic and military courts are to be transferred to common law courts. These courts were to be liquidated as they are inefficient and corrupt, according to the MPs.
