The Ministry of Justice considers it impossible to file a lawsuit to the Chisinau Court of Appeals, asking liquidating the Liberal Democratic Party (PLDM) and the Democratic Party (PDM), at the request of the creditors of IM Eventis Mobile SRL, IPN reports, quoting a letter of the Ministry that was made public by the newspaper Panorama.
The response letter signed by Minister of Justice Oleg Efrim says that the Ministry will ask the Chisinau Court of Appeals to dissolve a political party based on at least one of the following reasons: a) the party works based on amended statutes and programs and the amendments weren’t registered as required by the law; b) within one year of the adoption of a final decision limiting the party’s activity by Chisinau Court of Appeals, the party performed activities similar to those for which its activity was limited; e) the party was recognized as unconstitutional by a decision of the Constitutional Court.
The letter reads that none of the three mentioned reasons occurred and thus they cannot file an application to the Chisinau Court of Appeals.
However, the creditors of Eventis Mobile addressed an open letter to the Head of the EU Mission to Moldova Pirkka Tapiola, U.S. Ambassador to Moldova William Moser and the managers of all the international organizations and embassies working in Chisinau, saying there are all the reasons for dissolving the mentioned parties because the actions of their members are aimed against the sovereignty and territorial integrity of Moldova. According to the representatives of the company, the two parties make use of illegal methods in order to achieve their goals.
Another reason mentioned by the creditors for dissolving the two parties is the fact that the ruling alliance divided the spheres of influence on the executive and rights protection bodies, which is usurpation of the state power.
According to the creditors, the parties also violated the Laws on the Political Parties and Article 41 (4) of the Constitution of Moldova, which says that the parties and other sociopolitical organizations that by their work and goals plead against political pluralism, the principles of the rule of law, the sovereignty and independence of Moldova are unconstitutional.
