The Constitutional Court declared the Parliament’s decision to abrogate the decision to name the directors of the National Agency for Energy Regulation (NAER) as unconstitutional. The Court ruled that once the Agency’s directors are appointed, these can be dismissed only by the procedure stipulated by the law, not yet by abrogating the appointment decision, IPN reports.
The Court held that the challenged decision was adopted by neglecting the constitutional norms and by defying the rule of law principles and the supremacy of the Constitution.
The constitutionality of the Parliament’s decision was channeled by a group of MPs.
On December 3, Parliament dismissed the NAER directors by abrogating the own appointment decisions.
