Extension of rent term for Airport spaces declared unconstitutional

The legal amendments by which the rent term of the commercial spaces of the Chisinau International Airport was extended from 3 to 5 years in May were declared unconstitutional. Such a decision was taken on Thursday by the Constitutional Court, which was notified by a group of MPs of the Bloc of Communists and Socialists, IPN reports.

The MPs pointed out that the provisions of the Parliament’s Rules of Procedure, the Law on Normative Acts and those on transparency in the decision-making process were not obeyed in the law-making process.

The Constitutional Court noted that compliance with the procedural requirements relating to the adoption of laws is as important as compliance with the requirements applicable to the content of laws. The Court held that both the amending law and the amended laws are organic laws, which are adopted by a majority of votes of the elected MPs, after at least two readings.

Following the examination of the complaint, the Court declared unconstitutional Article 13 paragraphs (41) and (42) and item 261 of the Annex to Law No. 121 of May 4, 2007 on the administration and privatization of public property. The decision is final, cannot be appealed, enters into force on the date of adoption and is published in the Official Gazette.
