If steps are not taken immediately, Moldova could collapse, Justice Minister

What's happening in the judiciary system is serious and if no immediate measures are taken Moldova risks collapsing. The people leave the country not only because they do not have jobs, but also because there are no opportunities and they are disappointed with the legal system in our country, said Minister of Justice Alexandru Tanase. The statements were made at a ceremony held to launch a brochure titled “Reform of the Legal System in Moldova. European Standards and National Realities” held by the Foundation for the Promotion of Reforms in the Judiciary System. The new Minister of Justice said that the structure of the judiciary system must be modified, including by liquidating the inefficient institutions. According to him, no spectacular dismissals from the former administration of the Ministry are planned. “The persons who have the necessary professional qualifications will continue to work at the Ministry. We will propose bills to amend the structure of the legal system. At the next meeting of the government, we will discuss an important bill to modify and reform the notary offices. The bill provides for the liquidation of the state notary offices, which only spend public money and have no logical justification. “There will be only private notary offices,” Alexandru Tanase said. According to the Minister, the cases lost by Moldova at the European Court of Human Rights (ECHR) and those that will be yet examined are now being assessed. Negotiations will soon start with the plaintiffs so as to solve the cases in which Moldovan could be convicted amicably. The Ministry of Justice will undergo consistent structural changes. The governmental agent service will be strengthened. Owing to a poor administration in the judiciary system, last year Moldova paid 10 million euros damages over ECHR decisions and could pay 40 million euros more. “The Ministry will be open for cooperation with the civil society in implementing important and necessary projects and will give the judiciary the independence they need,” Tanase said. The Minister also said that proposals were made to modify the structure of the courts and remove the economic courts. “This is an important step in making the judiciary system more efficient and in eradicating corruption in this system. The economic courts' work leaves much to be desired as the number of plaintiffs that complained to the ECHR about the decisions passed by these courts is large.” “We will modify the mechanisms and system for implementing court decisions. The present government is in favor of private implementation systems. The legal profession will be also reformed. A new law on advocacy will be adopted or the existing law will be amended so as to institute certain internal regulatory instruments allowing the Bar to develop and be more efficient. “The Constitution will be also modified so as to change the functionality of the Constitutional Court and certain procedures concerning the appointment and promotion of judges at the Supreme Court of Justice. We will introduce certain amendments as regards the appeal methods, which caused a lot of trouble at at the ECHR,” Alexandru Tanase said.
