Last step in reforming system of enforcing court orders
“The modification of the court decision implementation system by making it private required reviewing the old paradigms and setting related costs that would be acceptable to the creditor and would allow the bailiffs to work efficiently,” said Minister of Justice Alexandru Tanase. Recently, the Government approved the regulations concerning the method of setting court decision implementation taxes, Info-Prim Neo reports.
“By our calculations, a court decision will be implemented at a cost of 600-700 lei. We think this is an acceptable price,” Alexandru Tanase said.
The taxes will be paid in advance under a relevant order. Unlike other countries with a private system of enforcing court orders, in Moldova the state will not cover the costs of implementing court decisions in such cases as levying of maintenance for children, reinstatement in posts and other categories of decisions from which the bailiffs do not earn money. According to Tanase, the budget cannot cover these costs now, but the bailiffs will recover their losses from implementing other decisions with a higher value.
“The approval of these regulations represents the last step in reforming the system of enforcing court orders. They are of major importance as the taxes for the documents drawn up by bailiffs and the costs of implementing court decisions are the main factors that can contribute to the success of this reform,” said the Minister of Justice.
