Minister of Justice finalizes bill package against corruption in justice

The Ministry of Justice (MJ) finalized and submitted for examination the package of legislative initiatives regarding measures of preventing and fighting corruption and the draft of the Law on testing the professional integrity of actors in the system of justice, Info-Prim Neo reports. According to a press release of the MJ, the bills are meant to ensure the application of one of the main goals of the Strategy of Reform in the Justice Sector, concerning the promotion and implementation of zero tolerance for manifestations of corruption. The MJ proposes changes to a set of normative acts, such as the Law on the Status of Judges, the Law on the Magistrates’ Superior Council, the Penal Code, the Law regarding the Application of the Polygraph Test and the Law on the Prosecutor’s Office. One of the main innovations concerns the mandatory polygraph testing of candidates for the position of judge and prosecutor. Another one is the inclusion in the Penal Code of a new norm that stipulates the extended confiscation of riches that cannot be justified and the introduction of a new crime component and namely “illicit enrichment”. The bill authors took into consideration the fact that extended confiscation is widely spread and regarded positively in most of the EU countries, especially Romania, where the Constitution, like in Moldova, presumes the legal character of the amassed wealth. The proposed amendments look to increase the penalties for crimes of corruption stipulated in the Penal Code. The communication of judges with the participants in the trial or third parties will be forbidden. The bills are available on the website of the Ministry of Justice.
