Minister of Justice Oleg Efrim considers that any other decision by the Constitutional Court (CC) may have seriously affected the constitutional system of Moldova, Info-Prim Neo reports.
“We cannot derogate from a procedure or a majority that is clearly specified in the Constitution by an organic law. This is against the principle of the supremacy of the Constitution and the principles of a state of law,” said the minister.
He agreed that the procedure for electing the head of state is not perfect and blocks the election of the President, but stressed that the supreme law must be respected despite this and can be amended only in accordance with the constitutional provisions.
On September 20, the Constitutional Court decided that the legislature cannot institute another majority for electing the head of state by organic law when the Parliament is dissolved repeatedly following the non-election of the President. Thus, the head of state is elected by 3/5 of the votes of MP, i.e. 61 votes, in any situation.
