Prosecutor general asked to take legal action against three judges

The administrator of the carrier “Milos M” Mihail Milos and the head of the Center for Initiatives and Public Authorities Monitoring Ion Dron requested Prosecutor General Corneliu Gurin to start criminal cases against three judges of the Chisinau Appeals Court, IPN reports.

In a news conference at IPN, Ion Dron said that in 2009 the Botanica Court ruled in favor of a person who claimed a debt of over 4 million lei from the administrator of “Milos M”, saying a loan released to him wasn’t repaid. According to the jurist, such a loan didn’t exist, while the person presented a false receipt in court. The decision was appealed to the Chisinau Appeals Court.

The head of the Center for Initiatives and Public Authorities Monitoring stated that the entrepreneur presented an assessment report produced by experts of the Ministry of the Interior, the National Anticorruption Center and the Examination Center of the Ministry of Justice, showing that the lending document was false as a text with the lent sum was written on papers with the company’s stamp and signature. The judges were obliged to thwart this attempt to appropriate property given the presented evidence. According to Ion Dron, the husband of a woman judge, who is also providing transportation services, is behind this propoerty diosposessin scheme.

Mihail Milos asked the prosecutor to establish if the acts of the Chisinau Appeals Court judges Nina Cernat, Anatolie Pahopol and Ana Gavrilita contain elements of such offenses as passing of an illegal decision and professional negligence.

The administrator and the jurist also requested the Supreme Council of Magistrates to institute disciplinary proceedings against the judges.

The jurists of SRL “Milos M” appealed the decision of the Appeals Court to the Supreme Court of Justice.
