SCM has two new members, one more member needed

The Parliament has appointed two new members to the Superior Council of Magistracy (SCM). These are Sergiu Băieșu and Tatiana Tabunchik, who were elected as a result of the competition staged by the Parliament’s commission on legal affairs, appointments and immunities, IPN reports.

The commission’s head Veronica Roșca said that a year ago, in October 2023, the legislature initiated the competition for the selection of SCM members. The competition took place in several stages. Recently, the interview stage was held and involved five admitted candidates. The highest score was obtained by Sergiu Băieșu and Tatiana Tabunchik.

“In accordance with the provisions of the Constitution and the Law on the Superior Council of Magistracy, the candidates for the position of member from among non-judges are selected through a transparent competition, based on merits, and are appointed by the Parliament with the vote of 3/5 of the elected MPs. Respectively, a minimum of 61 votes are needed,” said Veronica Roșca.

Sergiu Băieșu is a doctor of law and a professor in the Private Law Department of the Faculty of Law at the Moldova State University. He has over 30 years of experience in advocacy and participated in the drafting of a number of bills.

Tatiana Tabunchik is a doctor of law and an associate professor at the Moldova State. In 2022, she was appointed member of the Integrity Council within the National Integrity Authority.

Both of the SCM members appointed by the Parliament will serve a six-year term, without the possibility of holding two terms.

The Superior Council of Magistracy consists of six judges elected by secret ballot by the General Assembly of Judges and six non-judges appointed by the Parliament. Previously, the legislature named Tatiana Ciaglic, Ion Guzun, Alexandru Postica and Lucia Popescu to this post. Earlier, the General Assembly of Judges appointed Vasile Șchiopu, Ioana Chironeț, Sergiu Caraman and Maria Frunze – all four judges of courts of first instance. Aliona Miron was named member of the Council on behalf of the Supreme Court of Justice. One more member of the SCM is to be chosen from among judges of courts of appeals.
