Three of nine judges say they did not try cases in police commissariats last April, Promo-Lex

Three of the nine judges mentioned by Promo Lex Association and the Moldovan Institute for Human Rights (IDOM) in a complaint to the Supreme Council of Magistrates say they are accused groundlessly. In a communique, Promo-Lex says the Association was informed by the president of the Ciocana District Court Dumitru Mardari that judges Igor Manascurta and Ion Bulhac did not judge cases at police commissariats on April 7 and 8, 2009. The vice president of the Rascani District Court Oleg Meliniciuc said the same about himself. “We reiterate that the information included in the complaint is based on the materials of administrative and legal cases and the statements made by the persons who were arrested by the police during those days,” says the communique quoted by Info-Prim Neo. The communique also says that the registers containing information about the examination of cases in courts do not clearly indicate where the cases were tried, in courts or in police commissariats. It is not excluded that judges Oleg Meliniciuc, Igor Manascurta and Ion Bulhac judged cases in courts at that time. But there are conclusive proofs showing that the cases were tried in police stations. Promo-Lex and IDOM say it is the Supreme Council of Magistrates that should establish where the cases were examined and what illegalities the judges committed. They also say that the human rights organizations should inform the Supreme Council of Magistrates and the Ministry of Justice about reasonable suspicions, given the serious human rights violations committed during those days. “The use of torture and other forms of maltreatment is not allowed and the judges who ignored the visible signs of mistreatment at some of the detainees have no justification,” Promo-Lex says. The place where the cases were tried is only one element of the complaint lodged with the Supreme Council of Magistrates, which is to examine all the aspects and make a decision. The complaint was filed against judges Oleg Meliniciuc, Mihail Diaconu, Igor Vornicescu, Gheorghe Morozan, Igor Manascurta, Ion Bulhac, Ala Malai, Ludmila Cernei and Anatolie Galben.
