Law on prevention and combating of domestic violence is not implemented
It is one year after the law No. 45 on the prevention and combating of domestic violence came into force, but the ordinance on the protection of victims has not been put into practice, the victims being forced to find a refuge themselves, with the aggressor continuing to live in the same place. The law is perfect in theory, but not implemented. This conclusion was reached by the participants in a training course over the given law intended for judges, prosecutors and lawyers, Info-Prim Neo reports.
The participants said that the victims of domestic violence do not appeal to specialists because they do not know their rights or are afraid, while the patriarchal and discriminatory attitudes make the women more vulnerable. But the given law includes an implementation mechanism and the putting into practice of the protection ordinance should be hastened.
According to the Interior Ministry's Public Order Division, 26 offenses were committed against family members in the seven months to July, in contrast to 18 offenses last year. Eleven cases are murder cases, while 15 are cases of intentional bodily harm resulting from the hostile relations between family members. There were examined 1,550 complaints about domestic violence. This is 10.2% of the total number of complaints dealt with. 4,280 persons with a violent behavior inside the family were taken by the police under supervision.
The seminar brought together about 50 jurisprudence experts from several districts.
The training course for judges, prosecutors and lawyers held in Chisinau last week forms part of the Protection and Empowerment of Victims of Human Trafficking and Domestic Violence in Moldova Project, which is implemented by the UNDP, UNFPA, IOM and OSCE, with financial support from the Government of Japan, during 2008-2011.
