Communists contest Muruianu's dismissal as Supreme Court chief
The Communist Party will ask the Constitutional Court to verify the lawfulness of the parliamentary majority's decision to dismiss Ion Muruianu as president of the Supreme Court of Justice, Info-Prim Neo reports.
“We believe that this was an unlawful decision because the examination procedure was violated. At the moment when this decision was adopted, the documents on which it relied hadn't yet been sent in by the Superior Magistracy Council; they arrived later”, said Sergiu Sirbu, the Communist Party's lawyer, listing one of several procedural violations found by the party.
“We believe that there has been a serious violation of the principle of separation of powers in the state. Lately, we have witnessed immense pressure being exerted on the entire judicial system and we believe that there has been an interference of the legislative power in judicial affairs”, added Sergiu Sirbu.
Ion Muruianu was dismissed on Tuesday by Parliament on the Liberal Party's initiative. The same day, in a parallel development, the Superior Magistracy Council proposed Muruianu's dismissal to the legislature.
In March 2010, Ion Muruianu was dismissed by Parliament, but shortly reinstated by the Constitutional Court, who noted that the Superior Magistracy Council's opinion hadn't been asked. Muruianu drew heavy criticism from media, civil society and some politicians especially after he called journalists “rabid dogs” in February 2010.
