There are other methods of electing head of state besides those enumerated by Premier, expert
Another method for electing the head of state, besides the two enumerated by Prime Minister Vlad Filat, can be identified, considers constitutional expert of the Association for Participatory Democracy (ADEPT) Corneliu Gurin. He stated for Info-Prim Neo that a referendum may he held to modify the percentage of votes by which the President is elected by the lawmakers. Such a proposal was earlier submitted by the Communist Party (PCRM).
Last year, the PCRM proposed amending Article 78 of the Constitution by including a third round of voting to elect the head of state in Parliament. Under the opposition’s proposal, the third round would allow electing the President by a simple majority of votes – 51.
”I understand that the Premier does not support such a proposal. Maybe there is certain logic. In early legislative elections take place, the PCRM can return to power and obtain the necessary number of seats. If it wins 51 seats, it obtains everything,” said Corneliu Gurin.
According to him, the parliamentary parties can reach a compromise as regards the election of the President only if they find a candidate accepted by everyone. “I don’t know if they can find a candidate who will meet all the requirements of the parties and of society. There should be held public consultations, with the entire society, as it is not the Head of Parliament or of the alliance that must be elected,” he stated.
Corneliu Gurin said that a new agreement whereby the parties will assume responsibility in the European integration process, about which Vlad Filat spoke, may be effective only if all the signatories honor their commitments. He stressed that such an agreement should be signed by the AEI parties as well as the extra-parliamentary parties and representatives of civil society and the business community.
In a TV program on Wednesday, Vlad Filat said there are to methods of electing the head of state – the ruling alliance and the opposition can reach a compromise over the candidate for the presidency, or the Constitution can be amended so that it allows for the direct election of the head of state. He also said that in order to break the impasse faced by the alliance, there should be signed a new agreement, centering on Moldova’s behavior in the European integration process.
