Detention term for identifying a person decreased from 72 to 6 hours
The detention term for identifying a person was reduced from 72 to 6 hours. The legislative body passed a bill with relevant amendments to the Penal Code in the final reading on April 6, Info-Prim Neo reports.
The bill was put forward by the Ministry of Justice. Under it, the judges will be obliged to include the evidence of the prosecution and those of the defense in their decisions, while the prosecutors will have to present the proofs not only in court, but also to the lawyer so as to give them time to prepare arguments.
The investigation of offenses was divided into two stages – the penal process that will start when the prosecution body is notified, and the criminal prosecution that starts when a relevant order is issued.
The bill envisions instituting a new appeal method – revision of cases following the passing of decisions by the European Court of Human Rights. This way, the implementation of the ECHR decisions will be ensured and the judiciary practice will be unified.
The amendments to the Penal Code are aimed at eliminating the gaps existing in the criminal legislation. They include a set of measures that are in line with the justice sector reform strategy and the Government’s work plan for 2011-2014.
