Former judge to be prosecuted

The Prosecutor General’s Office (PGO) on March 3 obtained the consent of the Supreme Council of Magistrates to taking legal action against ex-judge Serghei Namashko, of the District Economic Court. The judge is suspected of consciously passing an illegal judgment, IPN reports.

According to a communique of the PGO, in 2009 the judge confirmed the reconciliation transaction between the sides in a civil lawsuit filed by a firm that claimed a debt of 790,000 lei from another company, and ruled that the creditor should become the owner of four facilities. Based on this judgment, the cadastral body registered the ownership right over this property even if the facilities belonged to other persons who had no connection with the examined case.

The prosecutors established that the judge didn’t check who the legal owner of the property was , didn’t identify the representatives of the sides in the trial and didn’t check the powers of the participants in the trial in whose name the reconciliation application and transaction were signed.

Now that the Supreme Council of Magistrates gave its consent, the prosecutor general will take legal action against the former judge and will order all the related legal procedures. The prosecution in this case will be conducted by the Anticorruption Prosecutor’s Office.
