Patients sent to Diagnoses Center for examination advised to go to court

The medically insured persons who cannot benefit from examinations at the National Diagnoses Center based on assignment tickets can sue the National Health Insurance Company and the medical institution. The specialized information channel Sanatate Info says the legislation allows those who have a health policy to file a lawsuit, while jurists say the people can apply for pecuniary and non-pecuniary damages, IPN reports.

Recently, the National Diagnoses Center announced that the persons who need to be examined, but haven’t scheduled an appointment will be unable to have examinations at the Center based on the health policy until the end of this year. In an announcement, officials of the Center say they used up the quota of services set by the National Health Insurance Company. Consequently, they can provide examinations only for money. The Company said it will analyze the situation, noting it suspects defective management at the Center.

In the quoted article, the jurists say the Moldovans who found themselves in such situations can ask for damage in court as the law is on their side. Human rights lawyer Olesea Perean said the plaintiffs will have to prove the existence and size of the damage caused and the obtaining of a written, reasoned refusal from the medical institution is thus very important.

“The person who bought a health policy signed a kind of agreement with the medical authority that has particular obligations towards the medically insured person. The person is not to blame for the lack of money or defective management. The insured persons must benefit from free medical services based on the health policy, while the insurer is obliged to guarantee these services. In this case, the persons can definitely sue the two institutions,” said lawyer Tatiana Puiu.

The National Diagnoses Center on August 1 announced that they can no longer schedule appointments for examinations for persons with health policies and these should pay for being examined. For their part, officials of the National Health Insurance Company said they signed a contract and an additional agreement with the institution to the value of 51 million lei and the problem resides in the defective management.
