Prosecutor General Ion Munteanu has referred to the Constitutional Court two articles of the Amnesty Law amended by laws adopted in 2022.
The complaint relates to the amnesty granted on the occasion of the 30th anniversary of the proclamation of independence of the Republic of Moldova and concerns, in particular, the abolition of the condition concerning the absence of risk of recidivism for life imprisonment, in order to commute the sentence to 30 years imprisonment.
The Prosecutor General warns that this amendment may jeopardize public safety and is contrary to the constitutional principles of the rule of law and the protection of the life and integrity of the person.
The author of the complaint asks the court to suspend the application of the contested provisions until a final decision on their constitutionality, IPN reports.
Last week, on April 4, the parliament voted in two readings a law interpreting article 7 of the amnesty law in relation to articles 91 and 92 of the Criminal Code. Thus, persons sentenced to life imprisonment will not be able to benefit at the same time from the commutation of the sentence to amnesty and conditional release or the substitution of the unexecuted part of the sentence. The law was published the next day in the Official Journal.
