The legal framework of Moldova is generalized and does not provide explicit answers to all the situations. Those who implement the law should show creative spirit and good faith when interpreting it, but this happens seldom. Afterward, the blame will be put on the imperfect law, said the head of the Leal Resources Center of Moldova Vladislav Gribincea. Contacted by IPN, the jurist said not the Europeans, but the Moldovan people need the justice sector reform.
“A good thing is that the authorities officially admitted that we need profound reforms in this field. They even adopted a rather ambitious strategy in this respect. However, the statements or the documents are not sufficient for a real reform,” stated Vladislav Gribincea.
According to the jurist, a legal system of a high quality depends greatly on the common sense of judges. Regardless of the number of adopted laws, without a qualitative change in the work of judges, the society’s perception of justice will not significantly change. “The judges should receive higher salaries, while their work should be better monitored. The judicial practice should be standardized. Order should be made in the courts of law and the judges should change their attitude to those who appeared before them,” said Vladislav Gribincea.
He also said that corruption is a rigid problem for Moldova because in crisis situations most of the persons who resort to any behavior in order to solve the problem. “My perception is that corruption exists in the EU too, but it is not so spread. I think that in most of the EU member states, this phenomenon is not known, mainly because of the society’s mentality and the harsh penalties for such violations,” he stated.
The experience of Romania and Bulgaria showed that the reform of the justice sector is the hardest, especially in societies affected by corruption and with a political class without strategies views. Vladislav Gribincea believes that any change starts from the citizens. The people should contribute to removing corruption and should no more offer bribe and should inform the police when they are told to give bribe.
