The provisions of the collective contract and of the internal regulations on working conditions of salary earners will be excluded from the individual work contract. However, on employment the salary earner will receive the collective contract, the internal regulations and information about the security and health requirements. The given provisions form part of a bill to amend the Labor Code that was approved by the Cabinet, IPN reports.
The Labor Code was also supplemented with a new article that regulates the notion of stationing. This will represent the temporary impossibility to continue production activity by a unit, group of salary earners or a salary earner. The time of stationing that is not due to the employer or employee is remunerated with at least 2/3 of the main salary per unit of time set for the salary earner, but not less than a minimum salary, for each hour of stationing. In case of stationing that is due to the employer, this is obliged to compensate the salary earner. At the same time, if the stationing is due to the employee, this will not be paid for the hours during which he/she will not work.
The changes also provide that the employer will be obliged to issue free the certificate on work and salary at the institution to the employee.
Under the bill, the technical unemployment during a calendar year will not exceed four months, while the monthly allowance will represent 50% of the main salary.
