CC rejects application concerning unconstitutionality of Education Code provisions

The Constitutional Court (CC) rejected the application to pronounce on the constitutionality of Education Code provisions and a Government decision on the state order for training specialists in technical vocational and higher education institutions for 2015-2016, which was submitted by MPs Vasile Bolea and Vladimir Odnostalko, IPN reports.

According to the authors of the application, by some of the Education Code provisions, an external body is actually appointed to manage the education institutions. This is the Council for Strategic Institutional Development. The autonomy of the higher education establishments is thus annulled and this becomes a purely declarative legal provision. This seriously violates the rule of law principles and the right to autonomy.

The CC decided that the payment of a monthly allowance by the founder of a private university to members of the Council for Strategic Institutional Development does not violate this institution’s right to property. At the same time, the Council pursues the goal of ensuring high quality standards in higher education and it is not an excessive burden. The inclusion in the Council of members from outside the university is a guarantee that high quality standards are ensued at the higher education establishment.

The Court issued a note to Parliament, underlining the necessity of clarifying the method of founding, reorganizing and liquating private education institutions and the notion of ‘relevant ministry’ when choosing members of the Council for Strategic Institutional Development.
