The judges investigated criminally could be mandatorily suspended from post until a definitive judgment is passed by court. While suspended, the suspected judges will be unable to tender resignations or applications to be transferred. If the prosecution is stopped or the judge is acquitted, this is reinstated. The changes to the procedure for dismissing judges are contained in a bill drafted by the Ministry of Justice that was proposed for public consultations, IPN reports.
The bill contains a number of amendments to the Law on the Status of Judge. The law is to be supplemented with an article providing that the decisions by which the Superior Council of Magistracy gives the go-ahead to take legal action or opposes this should be explained and published on its website.
If the reasons for dismissing the judge change in the period between the issuing of the decision to discharge the judge and the submitting of the proposal to the President of the Republic of Moldova, or, if necessary, to Parliament, before a relevant presidential decree or Parliament decision is issued, the Superior Council of Magistracy is obliged to modify the given decision.
