Ministry of Justice suggests excluding eliminatory character of polygraph test

The Ministry of Justice worked out a bill to amend the Law on the National Integrity Agency. One of the amendments refers to Article 10 of the law and excludes the eliminatory character of the polygraph test, secretary general of the Ministry of Justice Anatolie Munteanu announced in the weekly press briefing at the Ministry, IPN reports.

According to Anatolie Munteanu, the current norm providing that the candidates who do not take the polygraph test are rejected goes against the framework law concerning probing of simulant behavior. This does not provide that the polygraph test results are a criterion for not accepting persons subject to the polygraph test to particular posts.

Other changes refer to Article 11 of this law, concerning the verification of the status of former employee or agent under cover of the Security and Intelligence Service (SIS), including of informer of these services until 1991. “This information should be confirmed by an own responsibility statement of the candidate only. The request for information from the SIS will be excluded. The SIS will only examine candidates based on the Law on the Examination of Holders and Candidates for Public Posts,” stated Anatolie Munteanu.

According to the secretary general, amendments are also proposed to the Law on the Declaration of Property and Personal Interests. It is suggested reviewing the notion of close person and specifying “husband” or “wife”. There could be also included the notion of effective beneficiary.
