Nearly 80 families who bought apartments in 2019 in a residential block in the Botanica sector of the capital's Botanica district are involved in a lawsuit with the construction company "Elat Neocons SRL". The tenants claim that after a recent lawsuit, the court declared their title deeds null and void, and the company claims that they did not pay the full amount for the apartments, this despite the fact that they paid in full, according to the previously issued purchase deeds, IPN reports.
At a press conference, the tenants said that the company's representatives claim that, in reality, not all the money had reached the company's accounts, and that the owners have no legal rights to the apartments. According to the administrators, the title deeds are not valid and the tenants have no rights to the apartments.
These accusations were rejected by the tenants. They claim that they paid in full and on time for their apartments, in possession of receipts and investment contracts: "We paid everything legally, we received the receipts, and now they are telling us that the apartments are not ours. It is an unbelievable situation and we don't understand what is going on," said one of the participants at the press conference.
The tenants complain that they were not properly informed about the judicial process and that they found out about the court's rulings later, and that their rights were violated, including because they were not summoned to court hearings.
The court's decisions were based on a series of actions by the company "Elat Neocons LLC", which allegedly retroactively canceled the cash receipts, which certified full payment for the apartments, the tenants say.
The people believe that this cancellation of the vouchers was carried out for illegal purposes, to cover up internal financial irregularities of the company and to resell the apartments at much higher prices than those originally paid.
"It's like buying a product and, after you have paid for it, the store would come and tell you that your voucher is no longer valid. This is exactly what is happening to us," explained another resident, who noted risks for a dangerous precedent in society.
All the people concerned in the case have gathered proof of payment, including investment contracts and cash vouchers, and have appealed to the relevant authorities to check the legality of the decisions.
"If our homes can be seized on the basis of illegally canceled documents, then no one can be sure that their property rights will be respected," another resident told a press conference organized to draw attention to their problem.
The tenants called on the authorities to ensure a fair and transparent judicial procedure that does not allow abuses by construction firms and other entities involved in such transactions.
