It is not within CC’s competence to annul President’s decrees, MP

It seems that the Constitutional Court (CC) exceeded its authority, the Liberal lawmaker Ion Hadarca said, when asked by IPN to pronounce on the April 22 decision by which the Court ruled that the President’s decree to designate Vlad Filat as Prime Minister is unconstitutional. According to the MP, it is not within the Constitutional Court’s competence to annul the decrees of the head of state, but he is yet to examine the ruling to be able to say more exactly.

“We must see the text first so as to be able to comment more accurately. We will come together to examine it. There may be steps to specify or interpret the things, not yet to challenge the Court’s decision,” said Ion Hadarca. He added that consultations will be held with a number of parties to discuss the situation.

According to the Constitutional Court, Vlad Filat cannot be Prime Minister designate as the Government was earlier dismissed by Parliament by censure motion, on suspicion of acts of corruption, and is thus unable to fulfill its duties. The head of state was to name a Cabinet member as acting Prime Minister who was to serve until the formation of the new Government.
